Terms of Service

The contract for using TrustNet: eligibility, acceptable use, disclosures to relying parties, liability, and disputes.

Document: TrustNet-Terms-v0.2 Version: 0.2 Updated: 2026-10-21 Status: Draft — counsel review pending Audience: End users

1Who we are

These terms are between you and SMILE SERVICES SRL, Bdul. Decebal 84, Piatra Neamț, Neamț, Romania (VAT RO26286942), operating the TrustNet service.

2Eligibility

You must be at least 16 years old. If you are under 18, you confirm that a parent or guardian consents to your use of the service and to these terms. If you use TrustNet for an organization, you confirm that you are authorized to bind it.

3Your account

  • You have one account. Keep your credentials and passkeys secure.
  • Provide accurate information and keep it up to date.
  • Tell us promptly if you suspect unauthorized access.
  • You are responsible for activity carried out through your account, unless the law says otherwise.

4The service

TrustNet separates authentication from identity representation. You create one account and present scoped personas to relying parties over OpenID Connect. A relying party receives a pairwise subject identifier and only the claims you approve.

  • We do not guarantee that an RP will accept a persona or a claim.
  • An RP is an independent service with its own terms and privacy notice.
  • Features labelled beta or preview may change or be withdrawn.

5Acceptable use

You must not:

  • use the service for unlawful, fraudulent, abusive or harassing activity;
  • impersonate another person or create personas to deceive an RP;
  • scrape, probe or overload the service, or bypass its security;
  • test security except under the published vulnerability-disclosure policy;
  • request or disclose special-category data without a lawful Art. 9 basis;
  • use the service to re-identify a pairwise subject identifier.

We may suspend or limit an account or RP that violates these rules or creates a security or legal risk.

6Your content

You keep ownership of the data, pictures and files you put into TrustNet. You grant us the limited licence needed to store, process, display and disclose them as you instruct, and to operate and secure the service. You confirm you have the rights needed to upload them.

7Relying parties

When you approve a disclosure, the RP receives the approved claims and is responsible for its own use, retention and security. We do not control an RP's website or its legal basis for processing.

8Availability and changes

We work to keep the service available, but we do not promise uninterrupted operation. We may perform maintenance, change features, or retire a feature with reasonable notice. Any service-level commitment applies only if a separate written order or SLA says so.

9Fees

TrustNet is free during the MVP. If a paid plan is introduced, the price, billing period, taxes and cancellation terms will be shown before you order. Consumers keep their mandatory withdrawal rights under OUG 34/2014.

10Intellectual property

TrustNet, its software, documentation and marks are owned by SMILE SERVICES SRL or its licensors. These terms do not transfer ownership. You may not use the TrustNet name or marks without written permission, except to refer factually to the service.

11Suspension and termination

You may stop using the service and request deletion at any time. We may suspend or terminate for a material breach, a legal requirement, or a security risk. On termination we delete or anonymize data as described in the Privacy Policy and the erasure workflow, subject to legal retention.

12Disclaimers and liability

The service is provided with reasonable skill and care. To the extent permitted by Romanian law, we exclude implied warranties and are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law (including mandatory consumer rights, fraud, and death or personal injury caused by negligence).

13Governing law and disputes

These terms are governed by Romanian law. The courts of Bucharest have jurisdiction, subject to mandatory rules that let a consumer sue in their own forum. Consumers may contact ANPC or an alternative dispute resolution entity (SAL). The EU Online Dispute Resolution platform was shut down in July 2025.

14Changes to these terms

We publish a new version with a date and version number. For a material change we ask you to accept the new version before you continue using the account. The acceptance record names the version you accepted.
